JUDGE DALE RETIRES

There will be a retirement reception honoring Chancellor Sebe Dale, Jr., 10th Chancery Court District, on Friday, November 12 at the Marion County Chancery Court Annex, 250 Broad Street in Columbia, from 2:00 p.m. to 6:00 p.m. All members of the bar are invited and encouraged to attend.
Dale’s district includes Forrest, Lamar, Marion, Pearl River and Perry Counties. He has served as Chancellor for more than 30 years.
He obtained an undergraduate degree from Mississippi College and his law degree from the University of Mississippi. He also completed courses at the National Judicial College in Reno, Nevada.
Dale served as chairman of the Board of Governors of the Mississippi Judicial College, chairman of the Mississippi Judicial Advisory Study Committee, chairman of the Mississippi Children’s Code Commission, and other professional leadership positions.
For his leadership he was honored with the Justice Achievement Award of the Mississippi Court Administrators Association in 1995; the Mississippi Supreme Court Chief Justice Award in 1996; the Lifetime Achievement Award of the Mississippi Bar Association in 1997; and he was named Distinguished Jurist by the Mississippi State University Pre-Law Society in 2000.
He is a veteran of World War II, and retired Colonel of the U.S. Army Reserve. He is a past president of the Magnolia Chapter of the Retired Officerss Association.

CHANGING LANDSCAPE IN CHANCERY COURT STATEWIDE

Lawyers from Meridian and Quitman often travel out of district to conduct business and try cases in other Chancery Courts. When they do in the coming year, they’ll have to adjust to some newcomers. Six Chancery Court Districts have contested races this judicial election year, and no matter who wins, several will result in new faces on the bench.
Nearby, in District 6, we have already bade farewell to Judge J. Max Kilpatrick, who retired effective June 30, and have welcomed new Chancellor D. Joseph “Joey” Kilgore, who was appointed by Governor Barbour to fill the post. Judge Kilgore had already qualified to run without opposition.
All of the other races across the state to replace retiring Chancellors,or, in one case, to fill a newly-created seat, are contested.
In District 7 (Tunica, Quitman, Coahoma, Tallahatchie and Leflore Counties), Place 1, Catherine Farris-Carter of Shaw and Tom T. Ross, Jr., of Clarksdale are vying to replace the retiring Judge William Willard.
Also in District 7, Place 3, W. M. Sanders of Greenwood and Jimmy Miller of Marks are facing off for a newly-created seat.
District 8 (Hancock, Harrison and Stone Counties) has six contestants to take the place of retiring Chancellor Margaret Alfonso. Qualified and running are: D. Scott Gibson, Jennifer Schloegel and Dara Skinner, all of Gulfport; and Robert G. Harenski, William E. Tisdale and Fran Yeatts, all of Biloxi.
In District 1o (Forrest, Lamar, Pearl River and Perry Counties), there are three candidates for Place 2, from which Judge Sebe Dale, dean of Chancellors, is retiring after a long and illustrious career. The candidates are Dawn H. Beam of Sumrall, Scott Phillips of Columbia, and Aaron L. Russell of Carriere.
There are only two incumbents facing opposition.
Chancery Judge Larry Buffington of Collins faces two opponents in District 13 (Covington, Jefferson Davis, lawrence, Simpson, and Smith Counties): Douglas MacArthur Magee of Mendenhall; and David Shoemake of Collins.
Chancery Judge Edwin H. Roberts, Jr. in District 18 (Benton, Calhoun, Lafayette, Marshall and Tippah Counties) is opposed by Helen Kennedy Robinson of Oxford.

BONDS IN ESTATES

Intestate Estates:
- the Administrator is required to give a bond equal to the value of all of the personal estate. § 91-7-67, MCA.
- Bond may be waived or reduced if (1) Administrator is the sole heir, or (2) all of the heirs are competent and agree in their sworn petition to waive or reduce bond, BUT
- The court may nonetheless require a bond to protect the creditors if the court deems it necessary to protect their interests. Smith by and through Young v. Estate of King, 501 So.2d 1120 (Miss. 1987).
- At any time that the court deems the bond inadequate, the court may require the Administrator to give a new bond. § 91-7-315, MCA.
Testate Estates:
- The Executor is required to give bond in an amount equal to the full value of the estate. § 91-7-41, MCA.
- Executor who is also a residuary legatee may give bond conditioned to pay all debts and legacies of the testator within one year. § 91-7-43, MCA.
- If the testator in the will directs that the Executor not be required to give bond, then none is required unless the court or the clerk has a reason to require a bond. § 91-7-45, MCA.
- Any creditor may petition the court to require the Executor to give a bond if the creditor believes that his or her claim is jeopardized due to bad management of the estate. § 91-7-45, MCA.
- State or national banks domiciled in Mississippi are not required to give bond unless directed by the Will. The court has discretion to waive the bond notwithstanding that the Will directs it. § 81-5-35, MCA.
